Who is eligible for severance pay in Belize?

The Caribbean Court of Justice held in Marin et al v Belize Telemedia Limited ([2025] CCJ 14 (AJ) BZ, judgment 5 November 2025) that an employer's obligation to pay statutory severance can remain an enduring obligation until it is discharged—particularly where pension or other benefits did not clearly account for severance owed under the Labour Act. That is separate from how long you have to sue in court (see the limitation FAQ below).

What is the limitation period for suing to recover unpaid severance?

This is a different question from whether severance is still owed. The Limitation Act, Chapter 170 of the Laws of Belize, governs how long you have to bring court action to recover unpaid sums—including statutory severance.

Section 4 generally requires actions to be brought within six (6) years from the date the cause of action accrued. That includes actions to recover sums recoverable by virtue of an enactment (such as the Labour Act) and, in some cases, actions founded on contract. Section 3 makes those periods subject to Part III of the Act.

Importantly, section 29(3) provides that if a debt or liquidated claim has accrued and the person liable acknowledges the claim in writing (signed) or makes any payment in respect of it, the right of action is deemed to accrue on and not before the date of that acknowledgment or last payment—so the limitation clock can start again.

The Ministry of Labour may have different processes and timeframes for administrative complaints. The Marin et al v Belize Telemedia Limited ([2025] CCJ 14 (AJ) BZ, judgment 5 November 2025) judgment interpreted the Labour Act for the parties in that case; the Government has stated that other claims should be assessed on their individual facts.
